2009 has seen changes to the Indiana Tax Sale Statute(s) and to Indiana Case Law. These changes may greatly effect you and your business. This seminar will focus on these changes and will attempt to provide valuable information to assist you to avoid running afoul of the changes as you proceed through the tax sale process.
This seminar is designed to assist attorneys, title insurance agents, real estate brokers, and others in protecting against tax sales pitfalls. We will discuss all aspects of purchasing at the tax sale or assisting clients in such purchases, from obtaining the tax sale certificate, to getting a valid tax deed and quieting title to the purchased property and obtaining title insurance. This course is taught by faculty who have dealt extensively with the Indiana tax sale and who have both practical and legal experience in dealing with issues that arise in this area. This course is developed against a background of applicable law using real-life examples to demonstrate issues that should be addressed when involved in the Indiana tax sale.
Tuition for the course is $349.00. This tuition entitles registrants to seminar admission and a specially prepared manual containing all study material for the course. This course has been approved for 7.5 hours of continuing education credits from the Indiana Department of Insurance and 7.2 hours of continuing education credits from the Indiana Continuing Legal Education Commission. The Indiana Real Estate Commission credits are pending.
William R. Richards is a private practice attorney in Indianapolis. He graduated from Indiana University School of Law in Indianapolis and is admitted to both the Indiana and Florida bars. Mr. Richards has worked in real estate law for more than 45 years and has participated in tax sales for many years. He will discuss the history and evolution of the Indiana tax sale.
Marc L. Griffin is a private practice attorney in Indianapolis, as well as an Indiana real estate broker and title insurance agent. He is a graduate of Indiana University School of Law in Indianapolis. He has been active in Indiana tax sales for more than 23 years and drafted legislation that reformed the state’s tax sale process. Mr. Griffin frequently consults with county officials regarding tax sale law. He will discuss the Indiana Tax Sale statute.
Brian Hicks is a private practice attorney in Indianapolis. He is a graduate of Indiana University School of Law in Indianapolis. Mr. Hicks has been active in tax sale litigation for more than 13 years and has represented appellants in numerous published tax sale opinions. Mr. Hicks will discuss new Tax Sale case law.
Scott Richards has participated in the Indiana tax sale for more than 20 years and is a graduate of the Thomas Cooley School of Law. He practices law with William R. Richards, P.C. Mr. Richards will discuss tax sale surplus; recovering overbids; hidden costs of the tax sale; and ways to avoid acquiring "lemons".
William Richards, Jr. (Billy) has bought and sold tax sale property in most every Indiana county since 1985 and has more than 20 years of title abstracting experience. He will discuss common problems with 4.5 tax sale notices, publication, and the purchase and sale of tax sale properties.
Timothy A. Lohrstorfer received his JD from U of IL in 1998 and has been employed as an attorney with the IRS’s Chief Counsel’s Office in Indianapolis since that time. In 2006 he was appointed the Associate Area Counsel (SBSE) of Indiana.
William J. Tucker is an attorney in Indianapolis with the law firm of Tucker & Associates. He has practiced law for more than 30 years and specializes in the field of real estate and bankruptcy. He will discuss bankruptcy and the Tax Sale.
Andrew Seiwert is an attorney with Feiwell & Hannoy, P.C. He practices in the areas of creditor’s rights and real estate, including litigation involving title insurance and tax sales. He received his B.A. from Purdue University and his JD from Indiana University School of Law-Indianapolis.
Katherine A. Starks received her JD from the Indiana University School of Law in Indianapolis. She will act as moderator for the seminar.
Richard D. Gilroy has been a private attorney in
Indianapolis, Indiana since 1972. He currently practices with the
association of Gilroy Kammen & Hill. He received his JD from George
Washington University. Mr. Gilroy has been a part-time Master
Commissioner in the Marion County Circuit Court since 1998. He will
discuss a local judges view of the Indiana Tax Sale.
Danielle Kaiser is an attorney and Vice President of
National Attorney’s Title Assurance Fund inc. (NATAF). She was a law
clerk for NATAF and became Assistant Underwriting Counsel & Member
Services. She is currently the Vice President of Title Underwriters
of Indiana, Inc. and a member of Legislative Committee & Membership
Committee of Indiana Land Title Association.
Teri Kendrick is employed with the Office of Corporation
Counsel with the City of Indianapolis. She serves as City Prosecutor
and is responsible for prosecuting violations of city ordinances.
Before joining the Office of Corporation Counsel in 1996, she worked
for the Marion county Prosecutor’s Office for six (6) years.
